1. This agreement constitutes an order for wedding portraiture services, including the taking of wedding pictures as agreed to by both parties: Paul Potter, (the Photographer) and Contracting Party (Client).
2. The client(s) retain full copyrights of their wedding photos and may make prints and/or electronic copies of photos taken by the photographer at any time and on any media. This includes photos taken before, during and after the wedding. The photographer retains the right to use the photographs for promotional purposes including but not limited to print and website.
3. If Photographer cannot perform this Agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to Photographer's illness or injury, then Photographer will return all fees to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of Photographer. Client(s) agree that an entire wedding cannot be replicated, reenacted or repeated for the purpose of a re shoot and limits Photographer's liability to the amount paid under this contract.
4. Upon agreement by both parties hereto, the Photographer will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all deposits are non-refundable even if the date is changed or if the wedding becomes cancelled for any reason.
5. The service fee, other fees, hours of photography, deposit and schedule of payments is per the the terms agreed upon previously by the client and photographer. An invoice/contract will be drawn up and signed by the photographer and delivered to the client in duplicate. The client will sign both copies and return the photographers copy to the photographer. No photographs will be processed and no rights are granted until timely payment is made in full. Late payment fees and /or NSF cheque fees may apply. The fee and/or deposit is non refundable in case of cancellation or date change by client with the following exceptions: The deposit may be transferred to a wedding on a new date if the Photographer has the new date available and if the Photographer is able find a replacement booking for the original date. In the event of cancellation by the client a portion of the deposit may be refunded if the photographer is able to find a replacement booking for the date.
